
Motor vehicle accidents are a frequent occurrence on our highways. Whether a collision involves a multi-car pileup on a freeway or a single vehicle crash on a back road, accidents lead to injuries of vehicle occupants. All drivers have a responsibility to act reasonably when operating a motor vehicle. The failure to do so is negligence and creates an actionable claim for damages when an injury results. Insurance companies handling injury claims have an adverse interest to an injured party. The insurance carrier desires to pay as little as possible on the claim. Our job is to maximize the recovery on the claim for our clients.
Not every vehicular accident arises, however, from a vehicle operator’s actions. Many crashes result from circumstances beyond the control of the drivers involved, including dangerous intersections that are poorly designed or inadequately maintained by municipalities, malfunctioning traffic devices, and even defective design of the vehicles themselves, i.e., SUVs that have a tendency to roll over due to a high center of gravity, or vehicle instability and loss of control because of tire tread separation.
