Welcome to the LADWP Billing Overcharge Settlement
The Settlement resolves a lawsuit arising out of alleged customer overbilling and other billing errors by the Los Angeles Department of Water and Power (“LADWP”) caused by, and related to, the defective implementation of the LADWP’s new billing system and/or damages incurred by customers participating in LADWP’s solar incentive program.
If you are a current or former LADWP customer overcharged for electric, water, sewage or sanitation services or otherwise damaged by LADWP billing practices between September 3, 2013 and December 30, 2016 or if you were damaged as a result of your participation in the LADWP’s solar incentive program between February 13, 2010 and December 30, 2016, you may be eligible to obtain Settlement benefits.
To settle the lawsuit, LADWP has agreed to reimburse customers for 100% of the amount(s) that they were over-billed or damaged.
Most customers will not be required to do anything to recover the amounts they were overcharged. Those amounts have been pre-identified by LADWP through a process verified as accurate and reliable by the Independent Billing System Monitoring Expert (the “Independent Monitor”) appointed by the Court. If the Court grants final approval of the settlement, the pre-identified amount will automatically appear as a credit on your LADWP account, if you are a current customer. If you are a former customer the pre-identified amount will be refunded to you. In cases where there was not enough information to determine an overcharge amount, some pre-identified customers will be required to submit a claim form and additional information in order to receive a credit or refund. Customers who have not been pre-identified but believe they were overcharged or otherwise damaged may also submit a claim form to recover any damages to which they believe they are entitled as a result of these billing errors.
To receive any additional damages not predetermined by LADWP and verified by the Independent Monitor, you must submit a claim form.
To summarize: LADWP will provide full refunds to Class Members for over-billing, other billing errors, and other damages occurring between September 3, 2013 and December 30, 2016, for electric, water, sewer and sanitation customers, and between February 13, 2010 and December 30, 2016, for solar program participants. If you are pre-identified as a Class Member whose damages can be determined without further information, you will automatically receive a credit on your bill, if you are a current customer, or a mailed refund check, if you are a former customer. Pre-identified customers who are satisfied with the pre-determined amount of their refund do not need to submit a claim form.
Action is required if you are:
- a Class Member who must submit a Claim Form in order to recover because your damages cannot be determined without further information; or
- a Class Member who wishes to contest the pre-identified amount OR submit a claim in addition to the pre-identified amount; or
- an LADWP customer who has not been pre-identified but wishes to make a claim for damages.
LADWP will review your claim form and any submitted information to determine if you are entitled to a refund. The Independent Monitor will oversee this process to ensure that it is accurate and reliable.
Completed Claim Forms must be returned with a post- mark no later than June 5, 2017 to be considered. If you have been notified by LADWP that the department must conduct a field work investigation to determine if any billing error occurred with respect to your account, then your Claim Form must be returned with a post-mark no later than 60 days from the date of the field work determination letter you will receive after the investigation is complete and a determination is made on the investigation.
